The Official Journal of the European Union C 150/17 has published on the 2nd July the prior notification of a concentration Fiat/Chrysler (Case COMP/M.5518).

On 23 June 2009, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 by which the undertaking Fiat S.p.A. (‘Fiat’, Italy) acquires control of the whole of the undertaking Chrysler LLC (‘Chrysler’, USA) by way of acquisition of shares.

The business activities of the undertakings concerned are:

• Fiat (OTC:FIATY): manufacture and sale of cars, commercial vehicles, agricultural machinery, construction equipment, automotive components and metallurgical products.
• Chrysler: manufacture and sale of cars and trucks and belongs to General Motors group.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of Regulation (EC) No 139/2004. However, the final decision on this point is reserved.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission. Observations must reach the Commission before the 12 July.
