New Agency for the Cooperation of Energy Regulators

The Official Journal of the European Union of 14 August 2009 contains the Regulation on the European Parliament and the Council  establishing an Agency for the Cooperation of Energy Regulators.

The Commission Communication of 10 January 2007 entitled "An Energy Policy for Europe", stressed the importance of completing the internal market in electricity and natural gas. It was noted that improving the regulatory framework at EU level was a key step towards that goal.

The OJEU of August 14th, 2009 reflects one of those improvements in the internal energy market that can lead to a better energy policy in the EU: EC Regulation No 713/2009, which created the Agency for Cooperation Energy Regulators.

Therefore, the Agency should monitor the regional cooperation between transmission system operators in gas and electricity, as well as the execution of the tasks of the European Network of Transmission System Operators for Electricity ( "ENTSO Electricity") and the European Network of Transmission System Operators for Gas ( "Gas ENTSO). The agency's involvement is essential to ensure that the cooperation between transmission system is efficient and transparent for the benefit of the internal market in electricity and natural gas.

To facilitate management of networks, the same Official Journal has published the two directives and the two regulations which set a single market for natural gas and electricity.

Thus, the Agency should monitor, in cooperation with the Commission, Member States and national authorities, the internal market in electricity and natural gas, and, where appropriate, reporting its findings to the European Parliament, the Commission and national authorities. Furthermore, it should help increase energy security, which is particularly important after Ucranian gas supply crisis, to implement the guidelines on trans-European energy networks and to make recommendations when it considers that the cooperation between transmission system does not produce the results required.

The Agency shall comprise:

  • An Administrative Board of Directors.
  • A Board of Regulators.
  • A Director.
  • A Board of Appeal.

The Agency shall:

  • Issue opinions and recommendations addressed to transmission system operators.
  • Issue opinions addressed to the regulatory authorities.
  • Issue opinions and recommendations to the European Parliament, the Council or the Commission.
  • Make appropriate decisions in cases on energy transmission networks, or on national regulatory authorities on cross-border areas.
  • Beam non-binding guidance framework.

The creation of this agency is complementary to other energy policies of the European Union, to create a secure energy and energy efficiency.
