    Limerick City Council wishes to appoint an Employers Agent to act as a direct advisor to the Project Manager, Office of Regeneration and to provide Project Management and Cost Management Services to the Office of Regeneration Technical Team in the delivery of the physical regeneration element of the Regeneration Programme.

    It is intended that provided there are sufficient suitable Applicants, the five (5) highest ranked Applicants will be invited to participate in the second stage of the procurement process. The most economically advantageous tender will be awarded the Contract.

    Applicants are not required to assume a particular legal form at this stage of the competition. Applications may be submitted from single entities or by groups. A group will not be required to convert into a specific legal form in order to submit a tender, but may be required to do so if successful and once it is to be awarded the contract. The Office of Regeneration also reserves the right to contract with each member of the group or on the basis of joint and several liability.

    III.2.1) Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers

    Information and formalities necessary for evaluating if the requirements are met: (1) All candidates will be required to produce a certificate or declaration demonstrating that they are not bankrupt or the subject of an administration order, are not being wound-up, have not granted a trust deed, are not the subject of a petition presented for sequestration of their estate, have not had a receiver, manager or administrator appointed and are not otherwise apparently insolvent.

    (2) All candidates will be required to produce a certificate or declaration demonstrating that the candidate, their directors, or any other person who has powers of representation, decision or control of the candidate has not been convicted of conspiracy, corruption, bribery, or money laundering. Failure to provide such a declaration will result in the candidate being declared ineligible and they will not be selected to participate in this procurement process.

    (3) All candidates will be required to produce a certificate or declaration demonstrating that they have not been convicted of a criminal offence relating to the conduct of their business or profession.

    (4) All candidates will be required to produce a certificate or declaration demonstrating that they have not committed an act of grave misconduct in the course of their business or profession.

    (5) All candidates must comply with the requirements of the State in which they are established, regarding registration on the professional or trade register.

    (6) Any candidate found to be guilty of serious misrepresentation in providing any information required, may be declared ineligible and not selected to continue with this procurement process.

    (7) All candidates will have to demonstrate that they are licensed, or a member of the relevant organisation, in the State where they are established, when the law of that State prohibits the provision of the services, described in this notice, by a person who is not so licensed or who is not a member of the relevant organisation.

    (8) All candidates will be required to produce a certificate or declaration demonstrating that they have fulfilled obligations relating to the payment of social security contributions under the law or of the relevant State in which the candidate is established

    Accelerated restricted

    Justification for the choice of accelerated procedure: Limerick City Council assumed responsibility for the Office of Regeneration in July 2012. A number of key regeneration projects were already at an advanced site / pre-site stage at this time with design teams and contractors appointed. In addition a number of Limerick City Council projects will now be undertaken as part of the regeneration programme. To ensure that the identified projects are developed to meet the requirements of the regeneration programme the Office of Regeneration wish to appoint an Employers Agent to manage the regeneration project on their behalf as soon as possible.

    VI.3) Additional information

    (a) The Authority is subject to the Freedom of Information Acts 1997 and 2003. The Candidate shall state if any of the information supplied by it in response to this notice is confidential or commercially sensitive or should not be disclosed in respect of a request for information under the aforementioned Acts. The Candidate shall state why it considers the information to be confidential or commercially sensitive. The Authority will consult with any Candidate / Tenderer about sensitive information before making a decision on any Freedom of Information request received.

    (b) Any contract award is subject to production of a current tax clearance certificate from the Revenue Commissioners in Ireland.

    (c) All costs incurred by candidates in preparing submissions must be borne by them. The contracting authority accepts no liability for these costs, irrespective of the outcome of the competition, or if the competition is postponed or cancelled.

    (d) The contracting authority may terminate this competition (or any part thereof), change the basis of and the procedures for the bidding process, at any time, or procure the contract by alternative means if it appears that it can thereby be more advantageously procured. The most economically advantageous or any tender will not necessarily be accepted.

    (e) Candidates should note that this is a two stage selection process with the successful candidates from the pre-qualification process included on the tender list for the ‘Call off Contract’ from which the framework will be established.

    (f) Applicants should be aware that each project will be executed using the Standard Conditions of Engagement for Consultancy Services (Technical).

    (g) All times set out in this contract notice are in local Irish time.

    (h) All monetary amounts shall be quoted in Euro.
