    CONTRACT SPECIFICATION
    6. Contract Description

    The works on Split bypass project: on the Section 01: Plano – Kaštel Sućurac/Kaštel Golimica, LOT 0: Plano, length 0,7 km - construction works of highway, i.e. construction of new (northern) 2 lane carriageway and improvement of the existing (southern) carriageway.

    7. Maximum Works Period

    The period for completion of works for section Plano is 18 months from the Notice to Commence. Completion period includes winter conditions and possible traffic restrictions during the summer season.

    CONDITIONS OF PARTICIPATION
    8. Eligibility

    This invitation to Tender is open on equal terms to any firms/legal persons participating either individually or as a group (Joint Venture) of Tenderers.

    9. Grounds for Exclusion

    Firms of a country may be excluded if, in accordance with a decision of the United Nation Security Council taken under Chapter VII of the Charter of the United Nations, the Employer's country prohibits any participation of firms from that country in works in other countries, or any payments to persons or entities in that country.

    10. Number of Tenders

    Each Tenderer shall submit only one Tender for this Section, either as a sole Tenderer, or as a partner in a Joint Venture. Tenders for parts of the Works will not be considered.

    Alternative tenderers are not permitted.

    11. Modification of Tender price

    Discount of the proposed Tender price is not permitted. Tenders offering any form of discount (as "last minute discount", in Tender form, in grand summary, in modification letter) will be rejected.

    12. Tender Security

    The Tenderer shall furnish, as part of its Tender, a Tender Security, issued by a commercial bank acceptable to the Employer, in the amount of 1 % of its Tender Price expressed in HRK. The security shall be a bank guarantee payable by the bank on first demand without objection. The Security will be returned to unsuccessful Tenderers upon completion of the tendering procedure and to the successful Tenderer upon signature of the Contract by both Parties (the Employer and the Contractor). The Security may be forfeited if the Tenderer fails to comply with the requirements stated in the Tender Documents.

    13. Pre-Tender Meeting

    The Employer will convene a pre-Tender meeting, which will take place at the Employer's premises in Vončinina 3, (floor IV, room 400) Zagreb on 9 August 2012, at 11:00 am.

    14. How to Obtain Tender Documents

    Tender Documents are available from the Employer, at the above mentioned address, second floor, room 208 (Ivan Maletić, tel: +385 14722486; fax: +385 14722411, e-mail: ivan.maletic@hrvatske-ceste.hr).

    Each Tenderer or partner in a Joint Venture has to buy Tender Documents.

    Upon a written request accompanied by evidence of payment, the Employer will send the Tender Documents by mail to a prospective Tenderer who submitted a request, but will in no way be responsible for possible delay in shipment or loss of these documents. Tenderers, who require delivery of the Tender Documents by courier will bear the cost of such delivery.

    15. Tender Submission Requirements

    Tenderers shall submit their Tenders in English language, using the standard forms included in Tender Documents, format and instructions of which must be strictly observed.

    16. Deadline for Submission of Tenders

    After the publication of this Procurement Notice in the Official Journal of European Union, i.e. not later than 31 August 2012, at 10:00 am. Any Tender received after this deadline will not be considered for evaluation and will be returned unopened to the late Tenderer.

    17. Public Tender Opening Session

    The time and venue of the Tender Opening Session: 31 August 2012, at 11:00 am, Vončinina 3, 10000 Zagreb, Croatia, room 400. Designated and authorised representatives of Tenderers may attend the Session.

    18. Tender Validity

    Tenders shall be valid for a period of 90 days after the deadline for submission of Tenders.

    SELECTION CRITERIA AND AWARD OF CONTRACT
    19. Selection Requirements

    Evaluation of legal, economic, financial and technical responsiveness of Tenders will be carried out in accordance with the following main considerations:

    — Successful performance in the past five (5) years i.e. contracts signed and projects completed as the prime contractor on projects similar by type, scope and complexity to the Works tendered in this procurement; namely

    in at least 2 contracts/projects of state road or motorway construction of a road section at least of minimum value HRK 10 000 000,00;

    — Average annual turnover in the past three (3) years (specified as completed works or ongoing works) shall be at least HRK 30 000 000,00;

    — Qualification and experience of key staff in accordance with the Clause 5.1. of Tender Data. Special attention of foreign companies is drawn to the conditions requested for Firm's qualification and key staff in accordance with the Croatian laws in force (Clause 5.1. Tender Data);

    — Equipment and machinery in accordance with (the Clause 5.1.) Tender Data.

    20. Contract Award Criteria

    The lowest evaluated price, as defined in the Instructions to Tenderers.

    21. Performance Security and Contract Award

    The successful Tenderer will be required to furnish a Performance Security in the amount of 10 % of its Contract Price expressed in HRK. Within 28 days after receiving the Contract signed by the Employer, the successful Tenderer shall provide the Employer with Performance Security for the Contract together with the signed Contract. The security shall be a bank guarantee payable by the bank on first demand without objection.

    Failure of the successful Tenderer to sign the Contract and furnish the Performance Security within that deadline shall constitute a breach of contract, and the Employer may award the contract to the next ranked Tenderer.
