    This Invitation for Tenders follows the General Procurement Notice Ref 6592-GPN-41492 for this project, which was published at 16 February, 2012 on the web site of the European Bank for Reconstruction and Development - www.ebrd.com.

    Bishkekskoe Trolleybusnoe Upravlenie, hereinafter referred to as "the Purchaser", intends using the proceeds of a loan and a grant from the European Bank for Reconstruction and Development (the Bank or EBRD) towards the cost of the Bishkek Public Transport Development Project.

    The Purchaser now invites sealed tenders from eligible suppliers for the following contract to be funded from part of the proceeds of the loan and the grant:

    Package №BPTD01 – Supply of Low and High Floor Trolleybuses, including incidental services, DAP (Bishkek), 20-32 weeks after advance payment receiving:

    Lot №1, Low floor trolleybuses 32 units

    Lot №2, High floor trolleybuses 44 units

    Tenders are being invited for one lot or both lots. Prices for each lot shall be indicated separately. Tenderers offering to supply both lots may offer discounts for an award of contract for both lots, and such discounts shall be considered in the evaluation of tenders.

    The tender will be conducted in accordance with the EBRD's "Procurement Policies and Rules". Tendering for contracts to be financed with the proceeds of a loan and grant from the EBRD is open to firms from all countries. The proceeds of the EBRD's loan and grant will not be used for the purpose of any payment to persons or entities, or for any import of goods, if such payment or import is prohibited by a decision of the United Nations Security Council taken under Chapter VII of the Charter of the United Nations or by the legislation of the Purchaser's country.

    To be qualified for the award of a contract, Tenderers making proposals for one lot or both lots shall meet the following minimum criteria:

    (a) in the case of a tenderer offering to supply goods under the Contract which the tenderer does not manufacture or otherwise produce, the tenderer has been duly authorised by the goods' manufacturer or producer to supply the goods in the Purchaser's country;

    (b) the tenderer has the financial, technical and production capability and capacity necessary to perform the Contract and must have at least USD 20 million for one lot and USD 30 million for both lots annual turnover in average for last 3 years, as well as must have the profitable result of economic activity in each of last 3 years and shall demonstrate that it has access to, or has available, liquid assets, unencumbered real assets, lines of credit, and other financial means sufficient to meet the production cash flow for the contract estimated as not less than 40% of the planned contract price;

    (c) the tenderer must have the successful experience of the execution of the analogous deliveries of trolleybuses with similar models (single or articulated) in a quantity not less than 160 units for one lot and 250 units for both lots in the last 3 years;

    (d) the tenderer or its agent will be able to carry out the supplier's maintenance, repair and spare parts stocking obligations prescribed in these tender documents.

    (e) the proposed models of trolleybuses must be contemporary and be produced in series. The total quantity of released in series trolleybuses must comprise not less than 100 pieces in last 3 years. Good's manufacturer must have a certificate of quality management system (ISO 9000, or its equivalent).

    (f) the tenderer shall provide accurate information on any current or past litigation or arbitration resulting from contracts complement or under execution by him over the last 5 (five) years. A consistent history of awards against the tenderer or any partner of a joint venture or consortia may result in rejection of the tenderer's tender.

    Joint ventures or consortia shall satisfy the following minimum qualification criteria:

    (a) The firm - leader of the consortium shall correspond to at least 50% of all the above referred qualification criteria on general experience and financial status.

    (b) The rest members of the consortium shall correspond to at least 25% of all the above referred qualification criteria on general experience and financial status.

    (c) Joint venture or consortium shall meet in whole criteria for delivery experience and production capacity, as well as the financial status referred to above, the corresponding data, that defines the overall capacity of the joint venture or consortium, shall be specified for each consortium member. Each consortium member shall meet the requirements for eligibility and trials.

    Tender documents may be obtained from the office at the address below upon payment of a non-refundable fee of 15,000 (fifteen thousand) KGS, including VAT, or equivalent in USD by exchange rate of National Bank of the Kyrgyz Republic on the date of payment.

    Upon written request and confirmation of nonrefundable fee payment, the tender documents may be collected from the office at the address given below or the documents will be promptly dispatched by courier or by e-mail to the address, indicated in the written request, but no liability can be accepted for loss or late delivery.

    To ensure that all tenders conform to the same acceptable technical standard and meet the minimum operating and performance requirements required by the Purchaser, a two-stage tendering procedure will be adopted and will proceed as follows:

    a) The First Stage tender will consist of a technical proposal only, without any reference to prices, and a list of any deviations to the technical and commercial conditions set forth in the tender documents; or any alternative technical solutions of trolleybuses a tenderer wishes to offer, and a justification thereof, provided always that such deviations or alternative solutions do not change the basic objectives of the project. Following evaluation by the Purchaser of the First Stage tenders, the Purchaser, if considered appropriate or necessary, will invite each tenderer who meets the qualification criteria and who has submitted a technically responsive tender to a clarification meeting. The proposals of all such tenderers will be reviewed at the meeting and all required amendments, additions, deletions and other adjustments will be noted and recorded in a Memorandum. Only qualified tenderers submitting a technically responsive and acceptable First Stage tender will be invited to submit a Second Stage tender.

    b) At the second stage, Tenderers shall be given the opportunity to revise their Technical Proposals to conform to the tender documents and shall be invited to submit a Priced Tender which will comprise Price Proposals together with the Revised Technical Proposals which shall be evaluated.

    First Stage tenders must be delivered to the address below on or before 15:00 (local time) on July 03, 2012 at which time they will be opened in the presence of the tenderers' representatives who wish to attend.

    All Second Stage tenders must be accompanied by a Tender Security: 130,000 (one hundred thirty thousand) USD per each Lot or 260,000 (two hundred sixty thousand) USD for both Lots or its equivalent in a convertible currency and must be delivered to the address below on or before the time and date of the submission deadline specified in the Letter of Invitation to submit Second Stage tenders, at which time they will be opened in the presence of the tenderers' representatives who wish to attend.
