    This Invitation for Tenders follows the General Procurement Notice for this project which was published in EBRD Procurement Opportunities on 30 November 2011.

    Jalalabad City and Vodokanal hereinafter referred to as the Purchaser, intends using part of the proceeds of a loan from the European Bank for Reconstruction and Development (the Bank) towards the cost of the Jalalabad Water Rehabilitation Project. The Purchaser now invites sealed tenders from Suppliers for the following contract to be funded from part of the proceeds of the loan:

    Procurement Package PP1: Sewerage Maintenance Vehicles including pipe cleaning vehicle, equipment for pipe cleaning compatible with pipe cleaning vehicle, equipment for mechanical pipe cleaning, and cesspoolage vehicle

    Associated services include the provision of full technical documentation including operation and maintenance manuals and instructions, as well as basic training for operation and maintenance of the equipment.

    Tendering for contracts that are to be financed with the proceeds of a loan from the Bank is open to firms from any country.

    To be qualified for the award of a contract, tenderers must satisfy the following minimum criteria:

    (a) In the case of a Tenderer offering to supply goods under the Contract which the Tenderer does not manufacture or otherwise produce, the Tenderer has been duly authorised by the goods' manufacturers or producers to supply the goods in the Employer's country. The Tenderer must thus provide a Manufacturer's Authorization Form from the manufacturers of these goods, for the items produced by the respective manufacturers. Furthermore the Tenderer must prove that he has been duly authorized by the manufacturer or producer of the equipment to supply the goods into the Purchaser's country;

    (b) The Tenderer has satisfactorily supplied similar goods and services to other purchasers. The Tenderer must thus provide the fully completed and duly signed Experience Form evidencing that the Tenderer has at least three (3) good references from similar projects he has implemented during the last five (5) years;

    (c) The Tenderer or its agent will be able to carry out the supplier's maintenance, repair and spare parts stocking obligations prescribed in these tender documents;

    (d) The applicant has to demonstrate that he has sufficient financial means to implement the contract, i.e. that he has an average annual turnover of not less than EUR 80'000 equivalent over the last three years. The balance sheets and income statements (preferably audited) for the last three years shall be submitted and must demonstrate the soundness of the applicant's financial position, showing long-term profitability. Where necessary, the Purchaser will make inquiries with the applicant's bankers.

    (e) The Tenderer shall provide a description of the firm's qualifications supported by QA/QC certification (e.g. latest ISO 9001 certificates of the manufacturers of the major equipment with a validity covering at least the supply period);

    (f) Litigation History

    (g) The applicant shall sign the form in Section IV confirming that he is not involved in any current or past litigation or arbitration resulting from contracts completed or under execution by him over the last five years.

    (h) The Tenderer will be excluded from participation in the procurement procedure if:

    - they are bankrupt or being wound up, are having their affairs administered by the courts, have entered into an arrangement with creditors, have suspended business activities, are the subject of proceedings concerning those matters, or are in any analogous situation arising from a similar procedure provided for in national legislation or regulations;

    - they have been convicted of an offence concerning their professional conduct by a judgment which has the force of res judicata;

    - they have been guilty of grave professional misconduct proven by any means which the Purchaser can justify;

    - they have not fulfilled obligations relating to the payment of social security contributions or the payment of taxes in accordance with the legal provisions of the country in which they are established or with those of the country of the Purchaser or those of the country where the contract is to be performed;

    - they have been the subject of a judgment which has the force of res judicata for fraud, corruption, involvement in a criminal organisation or any other illegal activity detrimental to the Communities' financial interests; and

    - following another procurement procedure or grant award procedure financed by the Community budget, they have been declared to be in serious breach of contract for failure to comply with their contractual obligations

    As a part of their tender, Tenderers shall sign the form in Section IV confirming that they are not in any of the situations described above, and that they do not fall into the categories listed above under point (h).

    Qualification criteria for joint ventures. Joint ventures (including) consortiums must satisfy the following minimum qualification requirements:

    1. The lead partner shall meet not less than 70 percent of the qualifying criteria for references and financial position specified above.

    2. The other partners shall meet not less than 30 percent of the qualifying criteria for references and financial position specified above.

    3. The joint venture must satisfy collectively and fully the other qualification criteria. All firms of the joint venture/ consortium have to provide the documentary evidence required under the above points b), d), e), f). The documentary evidence of the above points a) and c) have to be provided by and in the name of the lead partner.

    The participation at the pre-tender meeting is optional and not mandatory.
